Hall of Shame... Diaper Boy - EXONERATED?

Now, before you begin celebrating this small step in favor of Diaper Rights, consider a few things. 

First, Utah's 'Diaper Boy' is still a convicted sex offender. 

Second, he spent more than three years in prison. 

Third, his name has become synonymous with 'pervert' in the city he's from. 

And fourth, what he does has no place in the ABDL community at large. 

You may remember my past Hall of Shame posts about Barton Bagnes, aka 'Diaper Boy', a Utah AB/DL who was arrested for exposing his Elmo diaper to children as young as seven, and for printing and distributing fliers (in the shape of paper airplanes, which he flew across people's lawns) directing children to diaper fetish websites. 

Turns out, that's not actually illegal. 

In the state of Utah, at least. 

That's what the Utah Supreme Court recently decided. 

"In exposing his diaper, Bagnes undoubtedly startled those around him. A diaper in this context would certainly have been perceived as unusual, even disturbing," the decision said. "But it in no way resulted in the effective exposure of Bagnes’s private parts."

The justices indicated that a diaper, though unusual for a grown man to wear, affords more coverage than other kinds of undergarments.

They also noted that unexposed, internal sexual gratification is not punishable by law.

"The private realization of a fetishized sexual fantasy alone would not make his conduct criminal," wrote Justice Thomas Lee. "Our Victorian past is well behind us. We no longer live in a society where our style conventions and social mores clamor for head-to-toe cover-up. The opposite is closer to the truth."

Could this legal decision mean that we're one step away from all being able to openly wear diapers in public? 

Maybe!

But before you go acting all crazy, think about the consequences Mr. Bagnes has already faced. 

And the consequences our community faces every time someone in it does something stupid in public.

Dude is still fucked up, no matter what the court says. But I might just wear diapes in public now, haha. I live in the same city.
